  Speed Limits Artificially Low - Economics May Be A Contributing Factor

After receiving a speeding ticket, people often tell us that the area where they were pulled over is a "speed trap."  An article in the Detroit News seems to give added credence to that argument. 

Four years ago, Public Act 85 was passed into law requiring municipalities in Michigan to conduct speed studies to determine the proper speed limit of its roadways.  According to Lt. Gary Megge, head of the Michigan State Police Traffic Services Section, most cities, villages and townships have not complied with that requirement.  In support of Megge's assessment, the Detroit News reportedly reviewed 10 randomly selected Metro Detroit roadways identified as "speed traps" by the National Motorists Association and allegedly found that no speed studies have been conducted along those roadways in accordance with PA 85 since its inception.

Megge believes that one likely reason for the noncompliance is that communities want the revenue that is generated by issuing speeding tickets and that failing to conduct the required speed studies allows the municipalities to keep enforcing their speed limits that are "artificially low" according to Megge.  Megge is quoted to have said "I think money is part of it and I find it reprehensible that communities aren't following the law."

  High School Students To Be Charged With Marijuana Possession

Four Flushing High School students were caught with marijuana while at school last Tuesday, April 20th, according to Flushing Township Police Chief Dale Stevenson. Each of the students are expected to be charged with possession of marijuana.  The students were reportedly caught with "very small amounts" of marijuana and appeared to be "under the influence." There were other suspensions but further details were not provided.  A fifth student may also be charged for having an illegal drug.

  Accused Shoplifter Goes From Bad To Worse

Washtenaw County sheriff's deputies conducted a traffic stop on a car of a 20-year-old-man in the 2500 block of Holmes Road in Ypsilanti Township at 8 p.m. Wednesday.  It is reported that they discovered the man to be in possession of stolen merchandise from a shoplifting that occurred minutes earlier at a business known as Citi Trends located on Washtenaw Avenue in Pittsfield Township.  

The man was placed in the back seat of the patrol vehicle while waiting for the Pittsfield Township police to arrive.  The man then allegedly became upset and kicked out the side window of the patrol car.  Once moved to a second patrol vehicle, the man again attempted to kick out the window but was unsuccessful.

The man has been arrested and is expected to be charged with retail fraud and malicious destruction of police property.

  Sterling Heights Teacher Faces Felony Drug Charge: Heroin Found During Traffic Stop

A Sterling Heights school teacher is facing a felony drug charge after police found heroin in his possession.  It is reported that Edward Lincoln Youngs of Warren, MI was arrested Friday after police discovered less than 25 grams of heroin in his possession during a traffic stop.  Mr. Youngs allegedly teaches physical education at elementary schools in both Sterling Heights and Troy.  A preliminary hearing has been scheduled for April 27th.

  Preliminary Exam To Be Held In Case of Drunken Driver vs. Amish Buggy

A 32 year old Coleman man is facing a preliminary examination this week in connection with a head on crash with an Amish horse and buggy that occurred on February 14th in Beaverton Township.  It is reported that Joshua S. Inscho faces one count of operating a motor vehicle while intoxicated.  Investigators are alleging that Inscho, while under the influence of intoxicating beverages, was traveling southbound on Bard near Lang in Beaverton Township, when he struck the Amish rig, killing the horse and injuring two of its riders.  The extent of the injuries sustained by the riders are unknown.  At the preliminary examination, District Court Judge Joshua M. Farrell must determine and rule upon whether probable cause exists for Inscho to be bound over to Circuit Court.

  Son Of Jackson County Judge Pleads No Contest To Armed Robbery

Charles Schmucker of Jackson, the 25 year old son of Jackson County Circuit Court Judge Chad Schmucker, has pled no contest to two counts of armed robbery.  Schmucker reportedly accepted a plea bargain moments before a jury trial was to begin on Monday.  It was reported that Schmucker also pled no contest to two aggravated assault charges.  All charges allegedly stemmed from an incident in which Schmucker robbed two men in a dispute stemming from a marijuana deal.  A no contest plea is not an admission of guilt but is treated as such for sentencing purposes.  A plea of this type is typically utilized if the Defendant is anticipating civil litigation.  It is expected that Schmucker will be sentenced on May 19.

  Drunken Driving Crackdown In Ann Arbor Leads to 13 Arrests and 48 Traffic Citations

In an effort dubbed "Michigan Night Patrol," officers from six area police agencies made 117 traffic stops and arrested four suspected drunken drivers near the University of Michigan campus during a crackdown effort over the weekend.

It was reported that officers issued 48 traffic citations during the crackdown which included 4 for suspected drunken driving, 2 for minor in possession of alcohol (MIP), 2 for no operator's license, 3 for driving on a suspended license, 1 for open intoxicants in a motor vehicle and 1 for possession of marijuana.  The federally funded effort is apparently designed to make late night traffic enforcement more visible by using lighted message signs, typically used during road construction, to alert motorists of the special enforcement.  Officers wear reflective traffic vests and hand out informational cards explaining the program to motorists pulled over for non-alcohol related traffic offenses.  The next enforcement crackdown is reportedly scheduled to take place in Chelsea on April 30.

  Farmington Hills Road Rage Suspect Pleads Not Guilty At Arraignment

Carl Mintz, the 27 year old Farmington Hills man accused of shooting a fellow driver who approached his car during an altercation, pled not guilty at his Arraignment on Tuesday to charges of assault with intent to do great bodily harm less than murder and felony firearm.

According to police, both men were traveling north on Orchard Lake Road in Farmington Hills on Monday afternoon when Mintz upset the 20 year old driver behind him by tapping his brakes repeatedly.  The victim then approached Mintz's car where the two exchanged words resulting in Mintz shooting him in the arm.  Mintz does have a permit to carry a concealed weapon, remained on the scene and called 911 after the shooting.  "It's not like I wanted to shoot the guy," Mintz said yesterday during his Arraignment at the 47th District Court in Farmington Hills before the Judge suggested he may want to speak with his lawyer before saying too much.  "(He) got out of the car, and he scared me."

  Drunken Driver Pleads No Contest In Deaths Of Four High School Students

The Detroit Free Press is reporting that Frances Dingle has pleaded no contest to four counts of second degree murder in the March 16, 2009 deaths of four Lake Shore High School students in an alcohol-fueled crash in Roseville.  Dingle was originally charged with four counts each of second degree murder and drunken driving causing death.  She will be sentenced on May 19, 2010 before Macomb County Circuit Court Judge Don Miller who is expected to sentence her to a minimum of 18-31 years in prison.

A no contest plea is not an admission of guilty but is treated as a guilty plea for purposes of sentencing.  Pleas of this type are typically utilized in anticipation of civil litigation and cannot be used as evidence in a civil trial.  In this case, Dingle is facing civil lawsuits in the deaths and alleges that she cannot remember much of the crash.  Dingle was accused of driving with close to double the legal limit of alcohol in her system when her van crashed into the teens' car which had been stopped at a traffic light.  Dingle previously told investigators she was in a drunken blackout after a daylong drinking bender.

  Ex-Powerhouse Heir Held Without Bond In Murder Case

Peter Dabish was ordered held without bond yesterday on first degree murder and torture charges in 36th District Court.  Dabish, the son of a Powerhouse Gym International co-founder, is accused of brutally beating his friend, 23 year old Diana DeMayo, last month at the Fort Shelby Tower Apartments in downtown Detroit.  The Novi native died of blunt force trauma to the head.  Although Dabish's mom offered her home as collateral for her son's release on bond, Wayne County prosecutors successfully argued for the need to keep him behind bars due to the brutal nature of the crime.  It was reported by Fox 2 News that Dabish's prior rap sheet includes two counts of malicious destruction of property, drug possession and assault and battery.  It was also reported by the Detroit Free Press that, days before the murder, investigators found a suspected marijuana-growing operation in a Waterford Township condo that Dabish was renting.

  Police Investigate Dad's Tale After 2 Year Old Daughter Is Shot

A Detroit man, who claimed that his 2 year old daughter had been shot in the back seat of his moving car, has been arrested after police found glass and shell casings in his driveway.  Police Sgt. Eren Stephens says the 32 year old is being held on outstanding warrants while the shooting is being investigated.  The man told the officers he was driving along a street in Detroit when he heard gun shots and a side rear window of his car shattered.  He took his daughter to a local hospital where she was in temporary serious condition with a gunshot wound to the hip.  Officers later found glass fragments and shell casings outside of the man's home leading to his arrest.  Although the shooting, and the man's story are under investigation, the man has not yet been charged in his daughter's shooting.

  Suspected Drunken Driver Kills Friend In Lyon Township Crash

Investigators intend to seek charges against a 28 year old South Lyon man suspected of drunken driving after his friend was killed in a recent head-on collision with a semi-truck.  "It sends a message that that's what can happen when you drink and drive," said Oakland County Sheriff's Office Sgt. Mark Venus who investigated the crash.  "A night of what you could call "fun" turns into a tragic thing like that.  Poor guy's going to have to live with the death of his friend for the rest of his life."  The crash occurred when the South Lyon man struck a truck after crossing the center lane and began travelling eastbound on Grand River in the westbound lane.  Investigators from the sheriff's Alcohol Enforcement Unit are expected to present a request for OWI charges against the driver to the Oakland County Prosecutor's Office in the next couple of days.

  State Senate Passes Texting While Driving Law

The state senate recently passed a bill that makes texting while driving a primary offense. The bill now moves to the state of House of Representatives for another vote.

If the bill passes, texting while driving would carry a $100 fine for a first offense and a $200 fine for a second or subsequent offense.

The bill could become law as soon as July 1 of this year.

Under current Michigan law, texting while driving is a secondary offense, which means police cannot ticket a driver for texting unless the driver committed another traffic offense.

State Sen. Raymond Basham (D-Taylor) said the purpose of the legislation isn't to punish drivers, but to fix the texting while driving problem in Michigan.

  Gibraltar City Council Adopts DUI Ordinance

Under a new ordinance recently adopted by the city of Gibraltar, people convicted of driving under the influence of drugs or alcohol could be forced to reimburse the city for money spent on the incident.

The money obtained under the ordinance would be used to help the city recuperate some of the losses it incurs from alcohol and drug related emergencies. These losses include costs for paying police officers and firefighters their normal wages, as well as overtime wages, and the cost of medical supplies and court personnel.

The ordinance, which affects drivers of cars, boats and snowmobiles, was unanimously adopted by the city council on March 22.
