| Prosecutors Seek Second-Degree Murder Conviction For Drunk Driver |
Testimony began yesterday in the criminal trial of Leonel Franco-Avina for the death of 30-year-old Aaron Haynes last November 23rd. Franco-Avina allegedly had a blood alcohol content of 0.425 when he drove the wrong way on the northbound lanes of East Beltline Avenue and hit Haynes head-on. Franco-Avina's alleged blood alcohol was more than 4 times the legal limit prompting the prosecutor's argument that Franco-Avina be convicted of second-degree murder, not drunken driving causing death. If convicted of second-degree murder, Franco-Avina could face life in prison and reportedly deportation.
