| Man Arrested For Possession Of Drugs With Intent To Deliver |
| Posted By Freedman & Freedman |
 |
At around 1:00 a.m. on June 25, 2010, police stopped a car near the entrance to Maplebrook Apartments on Maple Road in Grand Blanc for having a license plate light out. The officer allegedly asked the man if he had any alcohol or guns in the car to which the man replied "no" however, when asked about the presence of drugs, the man allegedly replied that "there shouldn't be any drugs in the car." After reportedly consenting to a search of the car, police discovered about one gram of heroin as well as various prescription drugs. The man was arrested for possessing drugs with the intent to deliver and transported to the county jail.
Letting a Michigan drug crimes lawyer review your case is one of the most important things you can do. You need someone on your side in court. By conducting an independent investigation, your lawyer may discover that law enforcement actually did not conduct a valid search and that the evidence obtained during that search may be inadmissible. This alone would greatly impact a case. You have the right to be protected from an unlawful search and seizure by law enforcement personnel. You also have the right to legal counsel in the face of any criminal charges, and this includes drug crimes.

| Man Shoots Himself During Traffic Stop |
| Posted By Freedman & Freedman |
 |
On Sunday evening, police allegedly began pursuing a 1962 Ford Falcon near North Avenue and 26 Mile Road in Macomb Township because the driver was driving erratically. In addition, the vehicle matched the description of a car that had left the scene of a home invasion 30 minutes earlier. In response to the traffic stop, the 24-year-old allegedly pulled into a private drive and proceeded to shoot himself twice in the chest before getting out of the car and falling to his knees. The driver was reportedly on parole after pleading guilty to a felonious assault offense in January and shot himself to avoid going back to jail. It has been reported that the suspect was to be arraigned as early as today from his hospital room on charges of carrying a concealed weapon and other firearm offenses.
The two passengers in the vehicle, Christopher Broers, 17, and Jeremy Bawkon, 21, were arraigned in New Baltimore District Court on charges connected to the home invasion that occurred earlier. Broers is charged with assault with intent to rob, while armed, assault with a dangerous weaponand firearm offenses. Conviction could result in life in prison. Bawkon is charged with first-degree home invasion, a 20-year-felony. The driver of the car is not expected to be charged in the home invasion.

| Number Of Injuries In Alcohol And Drug-Related Crashes Grows |
| Posted By Freedman & Freedman |
 |
According to the 2009 Michigan Drunk Driving Audit, the number of traffic deaths resulting from alcohol and/or drug-related collisions dropped from 379 in 2008 to 351 in 2009. However, the number of people suffering injuries as a result of crashes involving alcohol and/or drugs rose from 6,248 in 2008 to 6,271 in 2009. Michigan State Police director Col Eddie L. Washington Jr. stated that drugs are playing a larger role in traffic crashes and injuries although it is unclear whether the increase is due to "expanded drug testing requests by law enforcement following an arrest."
In 2009 45,893 alcohol and drug-related driving arrests were made.

| DUI Checkpoint Uncovers Goat In Trunk Of Car |
| Posted By Freedman & Freedman |
 |
The debate over the constitionality of DUI checkpoints has taken a new twist. A recent DUI checkpoint in Beford County, Virginia surveyed nearly 15,000 cars resulting in three (3) DUI arrests and a drug bust. It also surprisingly resulted in the rescue of a goat. According to the News Advance in Lynchburg, Bedford County authorities pulled over 32 year old Fiona Ann Enderdy and inquired about strange noises coming from her trunk. Fearing a human might be trapped inside, officers were startled to find a goat, bound at the feet and thrashing about inside the trunk. Ms. Enderdy, a transport from Great Britain, replied that the goat was a gift from a local farmer and that it is perfectly acceptable to transport a goat in the trunk of a car in Great Britain. Fortunately, an animal control expert was at the checkpoint to care for the goat, who appeared to be dehydrated and was sent to the pound for further care. Ms Enderdy, however, was not so fortunate as she was arrested and sent to jail after being charged with animal cruelty.

| Woman Arrested 207 Times Pleads Guilty To DUI Charges |
| Posted By Freedman & Freedman |

Rhonda Heisler, 42, and mother of two, pleaded guilty Tuesday morning in a general sessions court in Sumner County, Tennessee to two (2) counts of driving under the influence. William Lamberth, assistant district attorney, said he is pleased that Heisler stepped up and accepted her punishment to the DUI plea: two (2), one-year prison terms, to be served consecutively. As part of the plea agreement, A.D.A. Lamberth agreed to throw out two (2) felony counts of reckless endangerment against Heisler for consuming alcohol and pills behind the wheel while her two (2)young children were in the vehicle with her. Lamberth explained that it would've been impossible to get convictions on both the DUI charges and the reckless endangerment charges because Tennessee law already combines both into one state statute.

| Posted By Freedman & Freedman |
 |
In Michigan, 18 year old Kyle Lee Vinson of Marine City was arraigned this week. Vinson was charged with receiving stolen property and theft of services this past weekend.
According to local police, Vinson called Herring Motor Co. of Somerset Township because he was stranded on the Pennsylvania turnpike. When an employee from the company arrived to help, Vinson said that he did not have the $90 owed for services that were performed. He was also without identification.
At first, Vinson claimed that he was his stepfather, Kyle Lee Schram. It was later discovered that the vehicle Vison was driving was owned by Schram and reported as stolen on June 15th.
At this time, Vinson remains in Somerset County Jail in lieu of $15,000 bail. His hearing has been scheduled for a later date.

| 11-Carboxy-THC No Longer A Controlled Substance |
| Posted By Freedman & Freedman |
 |
The Michigan Supreme Court issued an opinion on Tuesday that greatly changes the law concerning the crime of operating a motor vehicle with the presence of a schedule 1 controlled substance in the body.
In a previous case, the Michigan Supreme Court held that 11-carboxy-THC, a byproduct of metabolism created when the body breaks down the psychoactive ingredient of marijuana, is a schedule 1 controlled substance under MCL 333.7212. MCL 257.625(8) makes it unlawful for a person to operate a vehicle if the person has in his or her body any amount of a controlled substance listed in MCL 333.7212. Therefore, the prosecution only needed to establish that a defendant had any amount of 11-carboxy-THC in his or her body while operating a motor vehicle, to be guilty of violating MCL 257.625(8) regardless of whether the person was actually "under the influence" of marijuana while operating the motor vehicle.
In the recent case, the Michigan Supreme Court held that 11-carboxy-THC is not a schedule 1 controlled substance. Therefore, a person cannot be prosecuted under MCL 2.57.625(8) for operating a motor vehicle with any amount of 11-carboxy-THC in his or her system.

| Police Still Looking for Arsonists |
| Posted By Freedman & Freedman |
 |
In Ann Arbor, police say that they are still looking for the individuals who caused a series of fires. It has been more than five weeks since fires have been set.
At this time, police say that they do not have any suspects for the arson cases, which started in the beginning of 2010 and included several trash and car fires. All of the fires occurred near student housing areas by the University of Michigan's Central Campus.
Recently, a spokesperson the University's Public Safety department said that that last fires occurred on April 17th, when fours cars were set on fire within a 20 minute time span. Days after the last round of fires, police announced that they had assembled a task force to investigate the arson cases.
Despite ongoing investigations, police say that they have no leads. They are also still waiting on results from the crime laboratory for a house fire that occurred on April 3rd. That incident led to the tragic death of a 22 year University student. At this time, a $5,000 reward is being offered to anyone who has information about the fires or who may have started the fires.
If you have been charged with a major crime, like arson, now is the time to discuss your options with a Michigan criminal defense lawyer. Contact Freedman & Freedman today to get the defense you need. |

| 21 Year Old Flint Man Arrested For Driving Under The Influence of Marijuana |
| Posted By Freedman & Freedman |
 |
A 21 year old Flint man was recently stopped on 1-75 near Grand Blanc Road for having fully tinted windows - a civil infraction commonly referred to as defective equipment. Upon approaching the driver, multiple officers noted that the man had bloodshot eyes and they could smell burnt marijuana in the car which apparently the driver had attempted to conceal with an overabundance of body spray.
The man initially denied the presence of marijuana in the car but upon additional questioning by police finally admitted to the fact that he had smoked a marijuana cigarette approximately 30 minutes earlier and also had marijuana hidden under the passenger seat. Police were able to recover 42 grams of marijuana under the passenger seat of the car. The man was arrested for driving under the influence of marijuana, taken to county jail where he was booked and his blood was drawn to test for drugs.
